| Order of court deleting section 354 PPC |
Following is the order of learned Additional Sessions Judge, whereby the learned Judge deleted the section 354 PPC being not made out:-

Although
offence under section 354 PPC has been included in the report under section 173
Cr.P.C. against the accused yet, it is crystal clear from the record that no
allegation has been levelled by the complainant regarding outraging modesty of
his female folks with intention of sexual abuse against the accused. Consequent
thereupon, this Court is of the considered view that offence under section 354
PPC is not made out in this case, whereas, prima-facie the offences under
sections 337-G, 279,452, 427, 337-F(v), 352,147,149 PPC are attracted in this
case, which are triable by the Court of learned Magistrate. In this backdrop,
instant file is humbly placed before the Worthy District & Sessions Judge,
Additional Sessions Judge/
Special Court under the Anti-Rape
(Investigation & Trial) Act, 2021”
