SUBJECT: LEGAL NOTICE
That I have been instructed by my client __________to serve you the following legal notice.
1.
That my client is in UAE for
the last almost 2 years. My client from his own bank Account bearing No.
___________ has transferred an amount of PKR 2,00,000/- each month since July
2021 in the Bank account of his deceased real brother namely ___________bearing
account No. 12124485522 at UBL, Kallar Syedan Branch, District Rawalpindi.
2.
That the total amount sent by
my client in the said bank account comes to Rs. 24,00,000/-. It is worth mentioning
here that my client has sent the said amount for purchase of an agricultural
land in Mouza _____, Tehsil and District ____ in the name of my client but unfortunately
the brother of my client lost his life before the purchase of agricultural land.
3.
That on application by the
legal heirs of _________, succession certificate has already been issued in
favour of legal heirs of deceased by Civil Court Kallar Syedan.
4.
That on getting knowledge
about issuance of succession certificate, my client has filed application for cancellation
of succession certificate as well as a suit for declaration and permanent injunction before the competent courts.
5.
That the learned Civil, while
accepting Application for interim injunction granted interim injunction vide
order dated__________.
6.
That regarding the above said
account, a case is pending before the civil court and you and your worthy branch
Manger of UBL, Kallar Syedan are the record holder of the above said account,
hence you and above said branch Manger are legally duty bound to issue the
statement of above said account’s
transaction completely to my client.
7.
That as a right, my client demanded
a statement of account his deceased brother from your worthy branch at Kallar
Syedan but my client was not provided any statement of account, hence this legal notice.
Therefore, through
this legal notice you are directed to provide complete statement of account No.
12124485522 to my client, failing which, my client shall have right to initiate
legal proceedings against you at your own risk and costs.
Note: A copy of this legal notice is retained in my office
for record and further necessary actions.
