WRIT PETITION UNDER
ARTICLE 199 OF CONSTITUTION OF ISLAMIC
Respectfully Sheweth:
1.
That the facts in brief leading to the filing
of the instant Writ Petition are that the petitioner has been running Hotel in
the name of “Farhan Hotel”, at Lower Bazar, Murree, Tehsil Murree,
District Rawalpindi since long.
2.
That in the year 2009 the Government of
Punjab announced to provide Sasti Roti at the rate of Rs. 2/- per Roti to the
public under “Sasti Roti Scheme”.
3.
That the petitioner’s hotel was enlisted/ registered
for providing Sasti Roti Sasti Roti Scheme and the Government of Punjab
provided the subsidized Atta to the petitioner thus the petitioner started
providing Sasti Roti to the public.
4.
That later on, it became very difficult for
the petitioner and other Tandoor owners enlisted with Government of Punjab, to
provide Sasti Roti to the public @ Rs. 2/- Per Roti because of so many expenses
in this regard like utility bills, labour, shop rent etc.

That due to the hardships which were being
faced by the petitioner and other enlisted Tandoor Owners, the Petitioner’s
Association “Nan Bi Association” District Rawalpindi submitted an application on
25-09-2009 to the DCO, Rawalpindi for redressal of their grievances as
mentioned in para No. 4 of this writ petition, thereafter matter was settled on 12-10-2009 between the “Nan Bi
Association” District Rawalpindi" and Government of Punjab through Deputy District
Officer (Tehsildar) Murree, in which the Government made assurance to redress
the grievances of the “Nan Bi Association”

That on the assurance made by the Government
of

That a number of applications were filed by
the petitioner for recovery of expenses incurred by the petitioner on the said scheme but till date,
the petitioner has not been compensated. Lastly, the petitioner filed an application
before Honourable Prime Minister of Pakistan for the redressal of the grievance
which was forwarded to the respondent by the Prime Ministers Public Affairs and
Grievances Wings, Ministry of Parliamentary Affairs, Cabinet Block,

That the respondent’s office forwarded the
matter to Assistant Commissioner Murree. The AC
Murree after receiving letter from the respondent, entrusted the case of
petitioner to concerned Halqa Patwari who
submitted his report on

That the fundamental rights of petitioner
as enshrined in the Constitution of Islamic Republic of Pakistan have been infringed.
10.
That the petitioner has been left with no
other option but to knock the door of this Honourable Court by way of filing
the instant writ petition.
PRAYER
It is most respectfully
prayed that the instant Writ Petition may graciously be allowed, and the respondent
be directed to decide the application of
petitioner for compensation without any delay
and to grant compensation for the expenses incurred by the petitioner on
the “Sasti Roti Scheme”
Any other relief which this Honourable Court deems just
and proper, may graciously be extended in favour of the petitioner, to meet the
ends of justice.
