Format of Application for
cancellation of warrant of arrest in Family Case
After passing of a judgment and decree by Family Court in a Family
Case, if the judgment debtor against whom, decree is passed is not paying the
decretal amount of any thing mentioned in the decree, the court may issue
warrant of arrest against judgment debtor, and to avoid his arrest, the
judgment debtor may file an application for cancellation of his warrant of
arrest. Following is the sample of Application for cancellation of warrant of

APPLICATION FOR cancellation
OF WARRANT OF ARREST OF THE APPLICANT/ Judgment Debtor
Petitioner most respectfully submits as
under: -
1.
That above titled execution petition is pending
before this Honourable Court and is fixed for today.
2.
That on ______________, warrant of arrest
of the applicant/ Judgment Debtor has been issued by this Honorable court due
to non payment of remaining decretal amount.
3.
That the total decretal amount is Rs. 380,000/-
out of which the applicant/Judgment Debtor has already paid huge amount of Rs. 276,000/-.
Only meager amount of Rs. 104,000/- is due against the applicant/ Judgment
Debtor and applicant/ Judgment Debtor is ready to pay the remaining decretal
amount.

That the applicant could not pay remaining
decretal amount because of _______

In the wake of above, it is, therefore,
respectfully prayed that the instant petition be accepted and warrant of arrest
