Format of Power of Attorney Overseas Pakistani
If you are an overseas Pakistani or permanently settled in Abroad
including UK, USA, Canada or any other country, and have any property /house in
Pakistan or any property has been devolved upon you being legal heir of your
father/mother etc, and now you want to sell your property/ share in property, you
can sell or transfer the property while living in abroad/ foreign country means
out of Pakistan, by appointing any one in Pakistan. For this, you have to execute
a Power of Attorney either Special Power of Attorney or General Power of
Attorney. Following is the sample of Power of Attorney for those who are
residing abroad/ foreign country.
GENERAL POWER OF ATTORNEY
Know all men by these presents, I, Umer Gohar Gujar son of Raja Abid Ali, holder of Pakistani Passport

do hereby be declare that late
Raja
Abid Ali son of Naseer Ahmed
(late) was father of
the Executant, who was owner in possession of a House No. CB-2233,
Street No. 16, Chaklala Scheme-III,
That father of Executant Raja Abid Ali has died on
I am staying
abroad,
therefore unable to supervise, look after and manage the above said house to
the extent of my inherited share
in the said house, so hereby appoint, constitute and nominate
my real sister Rizwana
Naz
daughter of Raja Abid, holder of Pakistani Computerized National Identity Card
No.37405-12122221-1, resident of House No. BB-334-C, Street No. 16, Krishan
Pura, Rawalpindi, Punjab, Pakistan to do following acts, deeds and things on my
behalf in respect of above said house to the
extent of my inherited share:-
1.
To manage, sell, mortgage,
pledge, gift, exchange, surrender, sub-divide or transfer the said property to
any other person or party through any lawful mode of transfer and to receive its
consideration through a legal and valid receipt in a lawful manner.
2.
To enter into agreement to
sell, and to execute Sale Deed or any other Deed for the purpose of transfer of
the said property, and to present the same for registration.
3.
To sign Agreement to Sell, Sale
Deed or all or any other documents, where required.
4.
To file Application,
Petition, Suit, Appeal, Revision, Review, Writ Petition and all other Applications/
Petitions and to pursue all the cases in any competent court of law including Civil
Courts, District Courts, Tribunals, Revenue Courts, Banking Courts, Criminal Courts, High Courts upto Supreme
Court of Pakistan and to defend all any or all the proceedings, if filed
against me, in the above said courts/forums upto Supreme court of Pakistan.
5.
To submit Written Statement(s),
and Written Replies, of all suits, applications, petitions etc.
6.
To attend the court, produce
evidence, make his own statement.
7.
To enter into a compromise
with the opposite party in furtherance of the case or refer the matter to
arbitration.
8.
To apply for certified copy
of any document, order, judgment and decree and obtain the same.
9.
To apply to any loan-giving
agency/institution/ bank for loan and to obtain the same.
10.
To apply for and obtain any
connection such as water, sui-gas, electricity and telephone and to pay the
bills to the concerned departments and to obtain receipt of bills, furthermore
to handle the tax matters regarding the said property and pay the property tax
to the concern department.
11.
To partition the property by
its metes and bounds, demolish the building, convert it in shape of houses, to
sanction Site Plan from Metropolitan Corporation or other concerned departments
and raise construction on my portion and use all above mentioned powers
regarding my property.
12.
To appoint further special
attorney regarding the above said property on our behalf and in our name as and
when required.
13.
GENERALLY to do, execute and
perform all other acts, deeds and things which may be deemed necessary by the
said attorney for the above said purposes.
14.
I hereby undertake to ratify
and confirm all and whatever my said attorney shall do or cause to be done by
virtue of this deed.
