APPLIATION UNDER SECTION 94 READ WITH SECTION 151 OF CPC FOR DIRECTION TO RESPONDENT NO.2 FOR MAINTAINING STATUS QUO ON DISPUTED PROPERTY

 

Respectfully Sheweth,

 

1.              That the above titled application was filed by present applicant for initiating contempt proceedings against respondent No.1 who in violation of the status quo order dated 22-02-2022 passed by this Honourable Court, has installed a door on the site of disputed property and has further made a concrete bed in front of his newly constructed door.

                          

2.              That along with the above stated contempt application, applicant also filed application for appointment of local commission on 23-09-2022 which was dismissed with following observation “As there was no order regarding construction but only parties were directed to maintain status quo to the extent of possession, therefore, there is no need to appoint local commission”.

 

3.              That the respondent No.1  despite receiving the summons of contempt proceedings and appearance before the court today in proceedings is violating the court order on the spot way of encroaching on the land of applicant.  

 

4.              That although, the concerned SHO was impleaded as respondent No.2 in contempt application but he did not appear today and case was adjourned for 29-10-2022.

 

5.              That the respondent No.1 is continuously violating the status quo order, therefore, it is requested that SHO police Station _____, Rawalpindi may kindly be directed to visit the disputed property and make sure the compliance of status quo order on the spot.

 

PRAYER:

 

It is therefore respectfully prayed that application in hand may kindly be accepted and SHO police Station ____, Rawalpindi may kindly be visit the land in dispute and stop any further violation of status quo order dated 22-02-2022 and report the compliance of the status quo order of this Honourable Court.
