SALE AGREEMENT (Biana)

OF ASKARI APARTMENT

 

This agreement is made at Rawalpindi on this ______ day of __________

Between

 

Rabia Sagheer Malik wife of Nabeel Asghar Khan Malik R/o Property No.16000-E, Askari-II, Chaklala Scheme-III Rawalpindi  (hereinafter called the ‘Seller’) of the One part

And    

 

Farhan Alam Mehmood Satti son of Muhammad Ishaq Ahmed Naeem R/o Mohallah Parat Kotli Sattian Distt Rawalpindi NIC No. 34405-1212121211-3 (hereinafter called the ‘Purchaser’ which expression where the context so admits shall include and mean his heirs also, successors-in-interest, legal representatives and assignees) of the other part.

 

Whereas the Seller is the owner of Askari Apartment No 100016-EB, 1st Floor alowng with a Garage on Ground located at Askari-II_Chaklala Scheme-III Rawalpindi,  hereinafter called the said property.

 

Whereas the seller has agreed to sell, convey, transfer and assign the said property together with all his rights, interests, estates and entitlements therein to and in favour of the purchaser the said property free from all encumbrances, loans, mortgages, claims, debts, charges etc. for a lump sum sale consideration of Rs. 40,50,000/-(Rupees Forty Lacs  Fifty Thousands only) and the purchaser has agreed to purchase the said property free from all encumbrance loans, mortgages, claims, debts, charges etc., from the above mentioned consideration on the same terms and conditions appearing hereinafter.

That the seller has this day on signing of this sale agreement received a sum of Rs.30,00,000 only)  through no. Pay Order No. 454542121211 dated 10/08/2004 Bank Al-Falah, Saddar Branch Rawalpindi from the purchaser as Biana The receipt of which the seller hereby, admits and acknowledges

The balance amount which is Rs.10,50,000/-(Rupees Ten Lacs Fifty Thousands only) excluding Transfer charges will be paid by the purchaser to the seller at the time of transfer of the said property. That the seller will be responsible for the transfer of the said property in the name of the purchaser of any of his nominee(s).

 

That after receiving NOC from the seller, the purchaser will be bound to transfer the above said property within 7 days after paying the balance amount.  The physical possession of the said property will be given immediately after transfer by the seller.

 

And that all liabilities and all prior, relevant dues pertaining to the subject property including House Tax, REC Asakri-III, Electricity, Gas, Telephone, Water, etc, if any will be paid/cleared by the seller for the period up to hand over the said property to the purchaser and all transfer charges will be paid by the purchaser.

 

That the seller and his legal heirs will never challenge it in any manner if the purchaser retains the above property with himself, or get it transferred in the name of his legal heirs or attorney or resells it to any other person.

 

IN WITNESS WHEREOF , both the parties have set their respective hands on this Agreement on the day, month and year mentioned above.
