REVIEW OF ORDER DATED 02-03-2022 PASSED IN THE ABOVE EXECUTION
Respectfully
Sheweth:
1)
That
the above titled execution petition is pending before this Honourable Court and
fixed for 29-03-2022 for compliance of direction by judgment debtor / Bahria
Town.
2)
That
this Honourable Court graciously directed
Judgment Debtor Bahria Town to cancel allotment of Plot No. 20001 Sector
G, Phase-10, Bahria Town, Rawalpindi However, the order for restoration of Plot
in the name of decree holder could not be
passed whereas in case the order
remains only to the extent of cancellation of plot No. 2001, the Judgment
debtor/ Bahria Town shall not restore the plot in favour of decree holder and
in this way, the decree holder shall be deprived to enjoy the fruit of decree dated
13-11-2020.
3)
That
if the order dated 02-03-2022 with direction to restore the Plot No. 20001 Sector
G, Phase-10, Bahria Town, Rawalpindi is not passed, the applicant/ decree
holder shall suffer an irreparable loss
PRAYER:
It is therefore respectfully
prayed that the instant application may kindly be accepted and the order dated
02-03-2022 be reviewed with further
direction to Judgment Debtor/ Bahria Town for restoration of Plot No. 20001 Sector
G, Phase-10, Bahria Town, Rawalpindi in favour of applicant / decree holder.
