Respectfully
Sheweth:
1.
That
brief facts of the case are that the Applicant filed a suit for dissolution of marriage, recovery of past
maintenance, dower articles and gold ornaments
against the respondent which was decreed in favour of the Applicant by
the court of Lubna Ahmed Butt, Judge Family Court, Rawalpindi vide Ex-Judgment
and Decree dated 30-07-2021.
2.
That
after passing the judgment and decree, the Applicant filed Execution
Petition which is pending before the court of Sajid Ali Malik, learned
Family Judge/ Executing Court, Rawalpindi and next date of hearing is fixed for
09-04-2022.
3.
That
the respondent is residing in District Khanewal, therefore the execution
proceedings cannot be carried out/ completed in Khanewal.
4.
That
due to above said reason, the above said Execution Petition along with complete
file and proceedings are required to be transferred in the court of Senior
Civil Judge Khanewal for execution of the judgment and decree.
5.
That
the applicant has no other alternate remedy except to file the instant
application for transfer of execution petition along with complete file and
proceedings.
PRAYER
Under the circumstances, stated above, it is therefore humbly
prayed that the instant application may kindly be accepted and the Execution
Petition along with complete file and proceedings pending before the court
of Mr. Sajid Ali Malik, Family Judge/Executing Court, Rawalpindi to the court
of Senior Civil Judge Khanewal, in the interest of justice.
Any
other relief which this Honorable Court
deems fit and proper, may also be awarded to the petitioner.
