That the applicant filed the suit
for Restitution of Conjugal Rights, titled as “Amjad Ali Raja Gujar Versus Rabia
Alam Amjad Khan” against the respondent which is pending in the court of Sumaira
Sagheer, learned Judge Family Court,

That the respondent also filed a
suit for Dissolution of marriage etc titled as “Rabia Alam Amjad Khan Versus Amjad Ali Raja Gujar”, against the
applicant which is pending in the court of Saleema Chaudhary, learned Judge Family
Court,
3.
That in both the suits, parties are
same and controversy between the parties are also same, so it is necessary to
avoid from conflicting judgments of the both suits, both the suits must be
consolidated/ transferred in one Court
PRAYER:
It is, therefore, respectfully prayed that instant
application may kindly be accepted and both the suits (1) Suit for restitution
of conjugal rights, titled as “Amjad Ali Raja Gujar Versus Rabia Alam Amjad
Khan”, pending in the court of Sumaira Sagheer, learned Judge Family Court,
Rawalpindi (2) Suit for Dissolution of marriage etc titled as “Rabia
Alam Amjad Khan Versus Amjad Ali Raja
Gujar”, against the applicant, pending in the court of Saleema Chaudhary,
learned Judge Family Court, Rawalpindi, may
kindly be consolidated/ transferred to one court to avoid from conflicting
judgments, so that the ends of justice could be fulfilled.
