APPLICATION FOR WITHDRAWL OF
SUIT
Respectfully Sheweth:
1.
That the applicant is
plaintiff in above captioned titled suit is pending adjudication before this Honorable
Court and is fixed for today.
2.
That due to certain
omission in the statement of facts and some other inadvertent mistakes of
technical nature, which may ultimately damage the cause of plaintiff, it is
necessary & expedient to file correctly and properly drafted a fresh suit
as per requirement.
3.
That due to above
mentioned facts, the applicant intends to withdraw suit, hence it is
appropriate to allow the applicant to withdraw the suit and to file a fresh
suit.
4.
That in case, the
instant application is not accepted, and the permission for withdrawal of suit is
not allowed, the applicant would suffer irreparable loss.
PRAYER:-
In view of above, it
is most humbly prayed that instant application may kindly be accepted and the applicant
may kindly be allowed to withdraw the above titled suit with the permission to
file a fresh correctly & properly drafted suit, in the interest of justice.
Any other relief which
this Honourable Court deems fit and proper be also awarded to the applicant.
