PETITION UNDER SECTION 22-A   CR.P.C.

FOR REGISTRATION OF CASE.

 

Respectfully Sheweth:-

 

1.               That brief facts giving rise to the instant petition are that the petitioner moved an application to the respondent No. 2 for registration of case against accused persons namely Zubair Masih son of Nabeel Chaudhary and Farhan Malik son of Raja Naseem, contending therein that the accused persons entered into the house of the petitioner and kidnap the petitioner’s son namely Haider Gill on ______at about ____a.m. (night) illegally forcibly, but so far no action has been taken by the respondent. (Copy of application is annexed herewith)  

 

2.               That the petitioner also moved an application to the respondent No.1 for registration of case vide dairy No. ______ dated: ______but so far no action has been taken by the respondent No.1 as well. 

 

3.               That admittedly a cognizable offence is made out from the contents of application moved by the petitioner but the respondents are not performing their duties enjoined upon them under the law and constitution.

 

4.               That the word “shall” has been employed in section 154 of the Cr.P.C., which is mandatory in its operation and made it obligatory on the local police to register the case, if any cognizable offences has been made out.

 

 

5.               That come what may the action of the police officials of not registering the case is an offence being patently illegal and they are liable to action.

 

6.               That from the contents of application a cognizable offence is made out, but the respondent No.2 is not performing his duties enjoined upon him under the law.

 

 

PRAYER:-

 

 

It is, therefore, respectfully prayed that a direction may be issued to the respondents to register a case against the accused persons, to arrest them and to proceed against them according to law, in the interest of justice.

 

Any other relief which this Honorable court may deem fit and proper be also awarded to the petitioner.
