APPLICATION
UNDER ORDER 39 RULES 1 AND 2 READ WITH SECTION 151 CPC
- That the above titled suit has been filed by the applicant in this Honourable Court, the contents whereof may kindly be read as an integral part of instant application.
- That the applicant has a good prima-facie case and hopes to succeed in it.
- That the balance of convenience lies in his favour of the applicant.
- That in case the stay order is not granted in favour of applicant the applicant would suffer an irreparable loss.
PRAYER:
Under
the circumstances, as stated above, it is therefore most respectfully prayed
that ad-interim injunction, restraining the respondents /defendants No. 1 &
2 from dispossessing the applicant/ plaintiff,
interfering, alienating, selling, transferring, changing the nature of
the suit property, entering into any
agreement to sell or any other agreement with anyone with regard to the suit property, creating any
third party interest in the suit property, till the final decision of the main
suit in any manner whatsoever, may kindly be issued in favour of
applicant/plaintiff.
